KHOMALL Platform Buyer Service Contract

This Agreement is entered into between you and KH transportation Express Co.

This Agreement relates to the online e-commerce commerce platform provided by KH transportation Express Co, Ltd, which is referred to as Khomall.

 

The contents of the Agreement shall enter into force

1. When the Buyer (Consumer) clicks on the registration button on the Khomall registration page and completes the registration process and receives the Khomall account number and password, the Buyer and Khomall shall be deemed to have entered into the Khomall Platform Buyer Service Agreement and to have entered into the entire agreement relating to the Buyer's access to Khomall for consumption (i.e. the Buyer's transactions with the Merchant through Khomall). 2. Khomall and the Buyer have carefully read all of the terms and conditions of this Khomall Platform Buyer Service Agreement (hereinafter referred to as "this Agreement") (including, without limitation, the terms in boldface type relating to the material rights and interests of Khomall and the Buyer) and all other terms of service and operating rules issued by Khomall. This Agreement and the foregoing Terms and Conditions are known, understood and accepted as the basis for determining the rights and obligations of both parties. Khomall's Legal Notices are an integral part of this Agreement and Buyer's acceptance of this Agreement shall constitute acceptance of all of Khomall's Legal Notices.

 

I. Definition Clause

1.1 Khomall: means the online trading platform developed, operated and managed by KH transportation Express Co., Ltd through which KH transportation Express Co., Ltd provides electronic voucher and product trading services to Buyers and Merchants, and in this Agreement, Khomall refers to the online trading platform.

1.2 Buyer: a registered member of Khomall who accepts and agrees to all the terms and conditions of this Agreement and all other terms and conditions and operating rules issued by Khomall, and who conducts transactions through Khomall.

1.3 Merchants: Natural persons, legal entities and other organizations that publish information about goods/services and offer goods/services to Buyers through Khomall.

1.4 Transaction: refers to the activity of trading goods/services between buyers and merchants through Khomall.

1.5 E-voucher: refers to the information about the goods/services of the e-voucher released by the merchant through Khomall and displayed on the Khomall site, including but not limited to the name, type, quantity, quality, price, expiration date, reservation time, merchant's address, delivery method, return and exchange method, refund policy, customer service, usage rules, etc. of the goods/services. E-voucher information legally constitutes an offer from the merchant to the buyer for the goods/services.

1.6  Price: the price of the goods/services to be paid by the Buyer to Khomall or the Merchant for the purchase of goods/services, the amount of which shall be based on the price and quantity agreed upon in the Purchase Order between the Buyer and Khomall or the Merchant.

1.7 Electronic Purchase Voucher: the electronic form of the purchase receipt or service receipt sent by Khomall to the Buyer by page, SMS, e-mail or other means, with the content of the Khomall password or code QR, etc. (to be determined according to the order), which serves as proof that the Buyer has paid the price and is entitled to the purchased goods/services.

 

II  Registration of the Buyer

2.1 Requirements for Registration: The Buyer represents that he has full civil rights and legal capacity or does not have full civil rights and legal capacity but has the consent of and is represented by his legal representative to register and use the services of Khomall.

2.2 Purpose of Registration: The Buyer undertakes that the registration of the Buyer is not for the purpose of violating laws and regulations or disrupting the flow of Khomall's network transactions.

2.3 Procedure of registration

2.3.1 Buyer agrees to provide a valid email address, place of residence and other information requested on the Khomall Buyer Registration Page to establish a Khomall account and password, and Buyer shall ensure the authenticity, completeness and accuracy of all information provided.

2.3.2 Buyers who provide the information required for registration in a lawful, complete and effective manner shall be entitled to receive a Khomall account and password, which Buyers may use to register as members of Khomall.

2.3.3 Buyer's registration shall be deemed successful when Buyer receives a Khomall account number and password, and Buyer agrees to receive emails and/or short messages from Khomall related to the administration and operation of Khomall.

 

III. Buyer's Services

3.1 Services

3.1.1 The Buyer has the right to view the information on electronic vouchers for goods/services in Khomall, the right to place orders with merchants through Khomall, pay for goods, receive electronic consumption vouchers (if any), etc.

3.1.2 The Buyer has the right to view the information under its Khomall membership account in Khomall and to use the functions provided by Khomall to perform operations.

3.1.3 The Buyer has the right to participate in the promotions organized by Khomall in accordance with the promotion rules published by Khomall.

3.1.4 Other services that Khomall promises to provide to the Buyer.

3.2 Service Rules

Buyers agree to comply with the following Khomall service rules.

3.2.1 The Buyers shall comply with the provisions of laws, regulations, normative documents and policies and shall not engage in any illegal or other activities that violate the rights and interests of Khomall or third parties in Khomall or the use of Khomall services, such as sending or receiving information that is illegal or unlawful, contrary to public order and morality, infringes the rights and interests of others, sending or receiving marketing materials or the presence of other harmful information or language, using or forging Khomall email headers without Khomall's permission, etc.

3.2.2 Buyers must use the Khomall platform for the purpose of lawfully completing the intended goods transaction and must not use the software or system errors that may be present in khomall to make illegal profits. Once this is detected, the khomall platform administration has the right to freeze their accounts and recover the illegal proceeds, and in serious cases will use legal means to defend the rights and interests of the khomall platform owner.

3.2.3 The Buyer is obliged to use Khomall account and password prudently and reasonably and keep them properly, and is responsible for the actions and events performed under his Khomall account and password. Buyers who discover that a Khomall account is being used by an unauthorized third party or that there are other problems with the security of the account should immediately and effectively notify Khomall and ask Khomall to block the Khomall account and report the incident to the police. Khomall reserves the right to comply with such requests within a reasonable time, but shall not be liable for any damages suffered by Buyer prior to such action.  The Buyer may not give, lend, rent, transfer or otherwise dispose of the Khomall Account to any other person without Khomall's consent.

3.2.4 Buyers shall comply with all provisions of the "Transaction Rules" of this Agreement and other terms and conditions and operating rules issued by Khomall for transactions with merchants through Khomall.

3.2.5 Buyers shall evaluate the goods/services in Khomall truthfully and according to the actual situation and shall not make malicious evaluations; Khomall reserves the right to pursue the matter.

3.2.6 Buyers shall participate in the sweepstakes and other activities of Khomall in accordance with the rules published by Khomall and shall comply with the order of activities.

3.2.7 Other terms and conditions and operating rules issued by Khomall.

 

IV Transaction rules 

The Buyer agrees to comply with the following Khomall Transaction Rules in its consumption on Khomall and its transaction with the Merchant through Khomall.

4.1 When searching for e-voucher information on goods/services on Khomall, the Buyer shall carefully read all contents of the e-voucher information, including but not limited to the name, type, quantity, quality, price, expiration date, reservation time, merchant's address, business hours, delivery method, return and exchange method, refund policy, after-sale service, usage rules, etc. Buyers should pay special attention to the expiration date, reservation time and refund conditions of the goods/services, etc. Buyers shall not click on the purchase until they fully accept all the contents contained in the e-voucher information.

4.2 Transmission and Confirmation of Order

4.2.1 The Buyer is obliged to carefully read the entire content of the order page, including but not limited to the entire content of the e-coupon information, the expiration date of the goods/services specified for the Buyer once again, the refund conditions, etc. (if applicable), the selection and confirmation of the purchase quantity, price, total amount to be paid, the Buyer's contact information for receiving the e-coupon or the receiving address, and the delivery date of the Goods. The entire content of the aforementioned order page constitutes the contract between the Buyer and the Merchant, and the Buyer may not place the order until it fully agrees with the entire content of the order.

4.2.2 The Buyer shall read and confirm again the entire content of the order before confirming the order and making the payment. By confirming the order by the Purchaser, the Purchaser shall be deemed to know and accept the entire contents of the order and to have entered into a contract with Merchant. All contents included in the order are contents of the contract, including but not limited to name, type, quantity, quality, price, expiration date, reservation time, Merchant's address, business hours, delivery method, return and exchange method, refund terms, after-sales service, usage rules, etc. Both the Buyer and the Merchant shall perform their respective rights and obligations in accordance with the aforementioned contract.

4.3 Payment of the Price After the Contract is concluded, the Buyer shall make the payment of the Price through the online payment platform in accordance with the instructions on the payment page. As Khomall is appointed by the Merchant to collect the Price from the Buyer on behalf of the Merchant, the Buyer shall be deemed to have fulfilled its obligation to pay the Price under the Contract by paying the Price to Khomall and making a successful payment. The Buyer shall not require the Merchant to deliver the Goods/Services to the Buyer before the Buyer has paid the Price.

 

4.4 Refund Rules

If the Buyer needs to make a refund after successfully paying the price, the following rules apply.

4.4.1 The Buyer has the right to request Khomall to make a refund on behalf of the Merchant if any of the following circumstances occur.

4.4.1.1 The Merchant is unable to deliver the goods/services to the Buyer after payment has been made due to force majeure or reasons for which the Merchant is responsible, as confirmed by Khomall.

4.4.1.2. If the Merchant has to change the content of the Contract after successful payment by the Buyer due to a genuine change of circumstances and the Buyer does not accept the changed content.

4.4.2 If the Buyer has actually consumed the goods/services and requests a refund from the Merchant or Khomall requests a refund on behalf of the Merchant, the Merchant and/or Khomall shall have the right to refuse the refund. However, this does not apply to cases where the goods/services seriously fail to comply with the contractually agreed content, have other serious quality problems or violate legal regulations.

4.4.3 If the contract expires but the Buyer does not consume within the validity period, the Buyer shall be deemed to have abandoned the goods or services and shall not be entitled to any refund from Khomall.

4.4.4 Refunds in other cases shall be made in accordance with the refund terms and refund methods agreed in the Contract Content.

4.4.5 During the refund procedure, the Buyer shall comply with the provisions of Khomall's General Terms and Conditions and the Operating Rules for Refunds.

4.4.6 Dispute Resolution Rules

If any dispute arises between the Buyer and the Merchant regarding the performance of the Contract, including but not limited to quantity, quality, price, expiration date, reservation time, address of the Dealer, delivery method, return method, refund terms, after-sales service, etc., Buyers should determine their respective rights and obligations, assume their respective responsibilities, and settle disputes with the merchant  according to the agreement of the contract.

Khomall may assist in negotiating and settling disputes between the Buyer and the Merchant. All chat recordings of chat tools used by Buyers when communicating with Merchants will be used as valid evidence of the Transaction Agreement, while chat tools outside the Platform will not be used as valid evidence of the Transaction Agreement.

 

V. Buyer's Rights and Obligations

5.1 The Buyer has the right to accept the web trading platform services provided by Khomall under this Agreement.

5.2 If the Buyer requires an invoice, other proof of payment, proof of purchase or service documents for the Goods/Services, the Buyer shall be entitled and obliged to submit them to the Merchant at the time of consumption of the Goods/Services, and the invoice amount shall be equal to the price actually paid.

5.3 If, during the consumption of goods/services, buyers find that the goods/services do not match the contents of the order or have other problems, such as quality or attitude towards service, they should negotiate with the merchant or resolve these problems in other ways. Khomall can provide buyers with the real registration information of the merchant's website and actively help buyers to resolve disputes with the merchant.

5.4 The Buyer has the right to terminate the use of the Khomall Services at any time.

5.5 The Buyer is entitled to exercise consumer protection rights and interests under Khomall's seven-day return policy without cause.

5.6 The Buyer shall ensure that all information provided during registration and order submission, such as name, contact information and contact address, is true, complete and accurate, and shall promptly update the information provided to Khomall if the above information changes.

5.7 The Buyer shall not maliciously disrupt the normal flow of transactions or interfere with the proper operation of the Khomall Platform when conducting transactions on Khomall.

5.8 Buyers shall not interfere, by technical means or otherwise, with the normal operation of Khomall or the use of the Khomall Services by other Buyers.

5.9 Buyers shall not damage the good reputation of Khomall or the Merchant by falsifying facts or otherwise.

5.10 Buyers may conduct transactions through Khomall only for genuine consumer purposes and not for commercial purposes such as resale.

5.11 Buyers shall cooperate in receiving goods or electronic consumer vouchers after successful payment.

5.12 Buyers shall not submit false transactions, false reviews or false complaints about the goods/services.

 

VI. Khomall's Rights and Obligations

6.1 If a Buyer does not have the requirements for registration agreed herein, Khomall shall have the right to reject the Buyer's registration and delete the registered Buyer's account as a member of Khomall, and Khomall shall have the right to claim compensation from the said Buyer or its legal representative for the damage caused thereby. Khomall also reserves the right to decide whether to accept a Buyer's registration under other circumstances.

6.2 Khomall has the right to suspend the use of the account if Khomall determines that the Account User is not the original applicant for the account.

6.3 If Khomall has reasonable suspicion that the information provided by the Buyer is incorrect, inaccurate, invalid or incomplete, Khomall has the right to notify the Buyer to correct and update the information. Khomall has the right to suspend or terminate the provision of Khomall Services to Buyers who fail to correct or update their true personal information in a timely manner.

6.4 Khomall has the right to correct any information displayed on Khomall if it is found to be obviously false.

6.5 Khomall reserves the right to accept the order of the merchant to make changes to the content of the order before the payment of the buyer. If the Buyer accepts the modified content, he may confirm the order and make the payment. If the buyer does not accept the changed content, he has the right to cancel the order. Khomall reserves the right to unilaterally change the content of an order by accepting the Merchant's request if the Merchant needs to change the content of the order due to changed circumstances after successful payment by the Buyer. If the Buyer accepts the amendment, the Buyer will consume the order as amended. If the Buyer does not accept the change, the Buyer has the right to cancel the order and request Khomall to refund the full amount on behalf of the Merchant.

6.6 Khomall reserves the right to modify, suspend or terminate the Khomall Services, and Khomall shall notify the Buyer of the exercise of the aforementioned rights in accordance with the procedures and modalities prescribed by law.

6.7 Khomall shall take the necessary technical means and management measures to ensure the normal operation of Khomall and provide the necessary and reliable trading environment and trading services to maintain the order of trading.

6.8 If the Buyer does not use the Khomall Member Account and password to log in to Khomall for one year, Khomall shall have the right to cancel the Buyer's Khomall Account after notifying the Buyer thereof. After terminating the account, Khomall has the right to open the corresponding member name for other buyers to register and use.

6.9 Khomall reserves the right to retain Buyer's registration information and all Buyer's transaction information during Buyer's use of the Khomall Services for the duration of this Agreement and after termination of this Agreement, provided that such information is not used unlawfully.

6.10 Khomall shall have the right to delete any type of information on Khomall's website that does not comply with national laws and regulations, regulatory documents or the provisions of Khomall's website, such as the Buyer's reviews, and Khomall shall exercise such rights without prior notice to the Buyer.

 

VII. Buyer Information

7.1 We are committed to protecting and respecting your privacy. The Privacy Policy respects and protects the individual privacy of all users of the Privacy Policy Web Services. In order to provide you with a more accurate and personalized service, our Privacy Policy covers the ways in which we collect, use, disclose, transmit and store your information. However, the Privacy Policy will treat this information with a high degree of diligence and duty of care. We may update this Privacy Policy from time to time. By agreeing to the Privacy Policy Network Services Usage Agreement, you agree to this Privacy Policy in its entirety. This Privacy Policy is an integral part of the Privacy Policy Network Service Use Agreement. You do not have to provide us with the personal information we request, but in many cases, if you choose not to do so, we will not be able to provide you with our products or services or respond to any questions you may have. 7.2.1 If you are a buyer: We will ask you to provide: Contact details, including name, gender, address, phone number, email address; Purchase and/or payment information, including the credit or bank card or similar payment information you intend to purchase, Billing and shipping addresses; information about your purchases, including the items and quantities purchased; image or text information for identification documents (such as passports) used for identity verification in some cases when applying for after-sales or account replacement services .

7.2.2 If you are a company seller: we will ask you to provide the seller's business information, including company business license (if applicable), contact number, email address; if it is an individual seller, we will ask for personal name, gender, contact number, email address, identity Photo or text information of the passport or passport. If the product is put on the shelf, we require pictures or videos of the product to better serve buyers.

7.2.3 If you choose to provide us with any other information to improve your service experience, this may include, marital status, international, date and/or year of birth, annual income, monthly expenses, user preferences. If you are unwilling to provide such information, the use of our services and products will not be affected.

7.2.4 If you are a buyer or seller or a potential buyer or seller, we will automatically collect relevant information: such as in the purchase and browsing activities of the platform and the industry activities participating in the platform, including the buyer's or seller's computer or mobile device’s IP address, MAC address, unique device identification number, hardware model, operating system version, browser type, buyer or seller location information; transaction and communication details on the platform, including the type and specifications of items sold, pricing and delivery information, records of any disputes, communications between buyers and sellers on the Platform and any information disclosed on the Platform.

7.2.5 Information we collect from third-party platforms: If you use a third-party social media account to register or log in to the platform. The exact information we receive depends on your privacy settings on the applicable social media, but typically includes basic public profile information, including your social media username, nickname or username, your social media avatar, country.

7.2.6 At the same time, in order to improve the security of buyers using the services provided by Khomall, and to more accurately prevent phishing website fraud and Trojan viruses, Khomall may learn about some buyersInternet usage habits and software information commonly used by buyers. Determines the risk of the buyer's account and may log some URLs that Khomall deems risky.

 

7.To protect the security of Buyer's information, Khomall has taken and will continue to take various reasonable physical, electronic and administrative security measures to protect Buyer's information from loss or destruction, including but not limited to encrypted storage of information, data center access control, etc. Khomall also takes strict administrative measures for employees or outsourced personnel who may have access to Buyer information, including but not limited to setting different permissions based on position and signing confidentiality agreements with employees.

 

7.Subject to the provisions of the law and in order to provide services to the Buyers and to improve the quality of such services, Khomall will use the Buyers' information for the following purposes.

7.4.1 To provide the Buyer with Khomall's various services and customer support and to maintain and improve those services.

7.4.2 To compare the accuracy of the information and match it with third parties. For example, to verify identity information submitted by Buyers to Khomall with the Services that verify their identity.

7.4.3 To send notifications about the status of the Services, marketing campaigns and other commercial electronic messages to Buyers to inform them about the use of Khomall's Services or to learn more about Khomall's Services.

7.4.4 To comprehensively count, analyze or process Khomall Buyers' identification data, transaction data, etc., and use, share or disclose them for reward purposes or to expand the social environment of Buyers; for example, Khomall may count new Buyers who sign up for a Khomall account in a certain period of time and offer exclusive promotions to these new Buyers.

7.4.5 To prevent or prohibit illegal activities.

7.4.6 Other uses that the Buyer permits.

 

7.5 Use of Cookies

7.5.1 In order to facilitate the Buyer's visit to Khomall websites or use of the services offered by Khomall, Khomall may identify the Buyer by means of small data files in order to save the Buyer from repeatedly entering his registration data or to ensure the security of his account. These data files may be cookies, Flash cookies or other local storage provided by the Buyer's browser or related applications (collectively, cookies).

7.5.2 The Buyer is aware that some of Khomall's services are only available through the use of "cookies". The Buyer may change the acceptance of cookies or reject Khomall's cookies if the Buyer's browser or a browser add-on service allows it, but this may in some cases affect the Buyer's ability to access Khomall's website and safely use the services offered by Khomall.

 

VIII Special Note

8.1 Any transaction between a Buyer and a Merchant that is not conducted through Khomall is not a Khomall Transaction, and Khomall shall not be liable for any transaction that is not a Khomall Transaction, and a Buyer may not file a complaint against Khomall or hold Khomall liable for any dispute with a Merchant arising out of such transaction. Cases that are not Khomall transactions include in particular: Buyer does not place an order with a merchant on Khomall; Buyer places an order with a merchant on Khomall (not a COD order), but pays the merchant directly without going through Khomall.

 

8.2 Khomall shall not be liable under any circumstances for any failure or delay of the Service due to maintenance of information network equipment, failure of connection to the information network, failure of computers, communications or other systems, power failure, strike, labor dispute, a riot, insurrection, civil commotion, lack of productivity or means of production, fire, flood, storm, explosion, war, governmental action, order of an administrative judicial body, other act of God, or failure of a third party. The Company shall not be liable for any failure or delay in the provision of services caused by the failure of a third party.

 

8.3 Fraud and Disruption of Trading Sequence

8.3.1 Except as otherwise provided in the Event Rules, each Buyer may participate in only one Event per Event (Events include, but are not limited to, special offers, seconds, lotteries, $0 price drops, etc.), and each Buyer may win only once. The same cell phone, contact information, IP address, Khomall account, ID, bank card number, shipping address, terminal number or other circumstances that reasonably indicate the same Buyer shall be considered the same Buyer.

8.3.2 During the event of trading, activities, sharing and other conduct permitted by the Platform, if a Buyer is found to have participated in the event by inappropriate means (including but not limited to violating the legitimate rights and interests of third parties, cheating, disrupting the system, conducting cyber attacks, malicious cashing, reputation enhancement, mass registration, registration of Khomall accounts with machines, simulation of customers with machines) that prevent other Buyers from fairly participating in this event or act against the purpose of the event. or The Event Organizer has the right to disqualify the winner of the prize or the rights and benefits received for participation in the Event. If the fraudulent conduct causes damage to the Organizer, the Organizer reserves the right to claim damages.

8.3.3 In case of malicious registration, repeated refund of transactions and violation of Khomall's actual business operations, Khomall will stop the service, block the account and pursue responsibility.

 

IX.Intellectual Property

9.1 All intellectual property rights in all intellectual works contained in Khomall, including but not limited to databases, website design, text and graphics, software, photographs, videos, music, sound and combinations thereof, software compilations, related source code and software (including applets and scripts) are owned by Khomall. The Buyer is not entitled to reproduce, modify, copy, send or use for commercial purposes any of the aforementioned materials or content.

9.2 All rights (including goodwill and trademarks) in the Khomall name are owned by Khomall.

9.3 By accepting this Agreement, the Buyer shall be deemed to voluntarily and exclusively assign to Khomall, without compensation, the copyright in the information published by the Buyer in Khomall in any form, including but not limited to: Reproduction rights, distribution rights, rental rights, exhibition rights, performance rights, screening rights, broadcasting rights, transmission rights in information networks, filming rights, adaptation rights, translation rights, compilation rights and other transferable rights belonging to the copyright holder Khomall shall have the right to bring a separate action for infringement by any subject and receive full compensation.

9.4 The Buyer shall not unlawfully use or dispose of the intellectual property rights of Khomall or others in the course of using Khomall's Services. The Buyer shall not publish the information already published in Khomall or allow other websites (and media) to use it in any form.

 

X.Customer service

Khomall provides a professional customer service team and a perfect customer service system to ensure the smooth flow of buyers' technical, personnel and system questions and complaints, and provide buyers with timely answers to their questions and feedback on complaints.

 

XI  Changes and Termination of the Contract

11.1 Changes to the Contract

 Khomall reserves the right to change the contents of this Contract or other terms and conditions and operating rules issued by Khomall, and Khomall will give notice in accordance with the procedures and methods required by law. If Buyer continues to use the Services provided by Khomall, Buyer will be deemed to have agreed to such changes. If the Buyer does not agree to the changed content, the Buyer has the right to terminate the Khomall account and stop using the Khomall services.

11.2 Termination of Agreement

11.2.1 Khomall shall have the right to terminate the Buyer's Khomall Account in accordance with this Agreement, and this Agreement shall terminate at the time the Account is terminated.

11.2.2 Khomall shall have the right to terminate all Khomall Services and this Agreement shall terminate on the date of termination of all Khomall Services in accordance with its legal procedures and methods.

11.2.3 Upon termination of this Agreement, Buyer shall not require Khomall to continue to provide services to Buyer or to perform any other obligations, including but not limited to Khomall's obligation to retain or disclose information in its original Khomall account to Buyer, to disclose information to Buyer or third parties that Buyer has not read or sent, etc.

11.2.4 Termination of this Agreement shall not affect the ability of the defaulting party to sue the defaulting party for breach of contract.

 

XII. Liability for Breach of Contract

12.1 Any breach of this Contract by Khomall or Buyer shall constitute a breach of this Contract and the defaulting party shall be liable to the compliance party.

12.2 If the Buyer breaches this Agreement and conducts transactions for commercial purposes such as resale, Khomall shall have the right to cancel the relevant transactions on behalf of the Merchant and shall have the right to terminate its Khomall Account and the Khomall Service for it, and if Khomall suffers losses as a result, it shall have the right to claim compensation for the losses from the Buyer.

12.3 If the Buyer causes any loss to Khomall or the Merchant due to untrue, incomplete or inaccurate information provided by the Buyer, Khomall shall have the right to claim compensation from the Buyer.

12.4 If the Buyer engages in illegal activities in Khomall or in the use of the Khomall Services due to violations of laws and regulations or of this agreement, Khomall shall have the right to immediately terminate the further provision of the Khomall Services to him/her, to delete his/her account and to claim compensation from him/her for the damage caused to Khomall as a result.

12.5 If a buyer disrupts the operation of Khomall or obstructs the use of Khomall by other buyers by technical means, Khomall shall have the right to terminate his/her Khomall account immediately and demand compensation from him/her for the damage incurred by Khomall as a result.

12.6 If the Buyer maliciously defames the good reputation of Khomall or the Merchant by falsifying facts or otherwise, Khomall has the right to require the Buyer to publicly apologize to Khomall or the Merchant, to compensate Khomall or the Merchant for the damage and to terminate the provision of Khomall services to him/her.

 

XIII. Entry into force of the contract

This Agreement shall become effective when Buyer clicks on the consent registration on Khomall's registration page and completes the registration process and receives a Khomall account number and password, and shall be binding on both Khomall and Buyer. This contract was issued on 01 January 2022.

 

 

Khomall 7-day return policy without cause

 

The "Khomall 7-Day Return without Cause Policy" refers to a customer service that Khomall merchants offer to their buyers through Khomall technical support and services. Specifically, this means that after the buyer pays for the merchant's goods, the merchant will unconditionally honor the buyer's request for return or exchange within 7 days from the time of receipt (7 days means the following 168 hours), provided that the goods has not been used, the original packaging is not damaged, and the merchant's secondary sale will not be affected (Goods with quality problems are not binded to this limitation.).

 

I. Terms and conditions when applying for "Khomall 7-day Return Policy without Cause".

1. Buyers can apply to the merchant for "Khomall 7-day Return Policy without Cause" if they do not want or do not like the goods; or the goods have quality problems when received.

2. Buyers shall make request of "Khomall 7-day Return Policy without Cause" to the merchant within 7 days from the date of confirmation of receipt of the goods.

3. The goods applied for "Khomall 7-day Return Policy without Cause" must be unused, with original package not damaged and not affecting second sale. Exception is that there are quality problems with the goods.

4. In terms of "Conditions of Return", see Appendix of polices regarding each product category.

5. Buyers who have made a request for "Khomall 7-day Return Policy without Cause" to the merchant within 7 days after receiving the goods, and have been rejected by the merchant or cannot reach the merchant, may make the request of "Khomall 7-day Return Policy without Cause" to Khomall (the Platform) instead.

 

II. Duties of merchants.

When merchant sells goods on the Khomall, it shall provide "Khomall 7-day Return Policy without Cause" to customers and and strictly follow below rules and policies,

1. The Merchant's implementation of the "Khomall 7-day Return Policy without Cause" is subject to relevant rules and regulations of Khomall. In the event of conflict between "Khomall 7-day Return Policy without Cause" and product description / product price / other product information / return policy provided at the time of order, the latter shall prevail.

2. The buyer is entitled to apply for "Khomall 7-day Return Policy without Cause" to the merchant within7 days from the time of receipt confirmation.

3. If the buyer makes a request for "Khomall 7-day Return Policy without Cause", and the merchant rejects it, the buyer can use "Platform Intervention" button to request Platform Intervene of the case. Khomall will have the right of deducting directly from merchant’s account  according to its fair and independent judgment, and oblige merchant to fulfill its obligation of "Khomall 7-day Return Policy without Cause". Within 20 business days after merchant’s receiving the returned goods (as per shipping record from logistics company), Khomall has the right to make aforementioned deduction and refund.

4. When a buyer inquires a merchant about the rules, the merchant has the obligation to explain clearly the rules and regulations to the buyer.

5. Khomall reserves the right to retreat merchant’s store from Khomall if it violates these rules severely.

 

III. Processing procedure.

1. The buyer shall first contact the merchant to request the return or exchange. If merchant accepts the request of the buyer, merchant and buyer shall agree on relative responsibilities of the return or exchange of the goods themselves.

2. If merchant rejects the return or exchange of the goods, or the two parties disagree on how to handle the return; buyer may use the service button “Refund” provided in the order. If the merchant rejects, buyer may use the "Refund" button again. When merchant rejects a second time, button “Platform Intervene” will pop out, buyer can use “Platform Intervene” to make the request. Khomall will provide final decision on the return and exchange dispute according to rules and regulations stated in this Khomall 7-Day Return without Cause Policy.

 

IV. Description on shipping responsibility.

1.Buyer requests return of goods when it binds non-merchant responsibility (merchant responsibility includes product quality problems, descriptions do not match received goods, etc.),    shipping costs is borne by buyer.

2.Buyer requests return of goods when it binds merchant responsibility (merchant responsibility includes product quality problems, descriptions do not match received goods, etc.), the shipping cost is borne by merchant.

 

 

Appendix: Return Policies against Respective Product Category

 

Small Appliance

1. Basic conditions for requesting return and exchange of goods. 

(1) the return of goods should be maintained in their original form as it is when the goods is received;

(2) the goods should be kept brand new; the relevant accessories are complete;

(3) warranty cards and other written materials attaching to the goods are not filled up, and have no defacement or folds;

(4) the original packaging, external package, original goods and attachments of the returned goods is kept intact;

2. Circumstances not eligible for the request of return or exchange of goods.

(1) the serial number of the goods differs as it is when merchant sold them;

(2) warranty label, body, package, warranty card bar code (S/N code) of the goods has been altered, torn, or moved;

(3) the purchase certificate has been altered, torn or lost;

(4) the machine has been damaged by unauthorized disassembly, repair or upgrade;

(5) the machine has been damaged because of improper usage, maintenance or storage stated in the user manual. 

(6) traces of manual damage / breakage caused by movement, dropping, collision, extrusion, etc.;

(7) missing accessories, stained package or serious residues on goods;

(8) damage caused by improper packing during transportation when returning goods to the merchant;

(9) factory seals stated specifically “not allowed to remove” is removed;

 

Automotive Products

1. Basic conditions for requesting the return and exchange of goods.

(1) goods should be maintained in the original appearance as it is when received; 

(2) the outer package, labels, accessories, etc. are intact; 

(3) No wear and tear on the appearance of goods and accessories;

2. Circumstances not eligible for return or exchange of goods.

(1) goods were damaged or used, affecting the secondary sale;

(2) warranty card, sale certificate, or accompanying accessories are stained, broken, or missing;  

(4) goods are damaged or broken by unauthorized repairs, misuse, neglect, abuse, accidents, alterations, or improper installation; 

 

Men's/Women's Wear

2. Basic conditions for requesting the return and exchange of goods.

(1) the returned goods should be preserved in their original condition (except that the goods  have quality problems when received);

(2) the package, labels, accessories, etc. are intact; 

2. Circumstances not eligible for return or exchange of goods.

(1) the goods are worn, washed, stained, damaged, etc., whichever affects re-sale;

(2) accessories, labels, packaging, etc., are damaged or lost;

(3) all underwear, special sizes ,tailor-made goods not eligible for return or exchange;

 

Shoehe bas and hats/bags

1. Basic conditions for requesting the return and exchange of goods.

(1) goods should be preserved in their original condition, except that goods have quality problems when received;  

(2) the outer package, labels, accessories, etc. are intact; 

(3) goods have no signs of use, no signs of washing, no signs of wear inside or outside, and do not affect the second sale.

2. Circumstances not eligible for return or exchange of goods.

(1) goods is artificially damaged; the label has been removed, etc.;

(2) goods show signs of use, wash, stains, or wearing etc. which affect the second sale.

 

Digital IT & Communication

1. Basic conditions for requesting the return and exchange of goods.

(1) goods should be preserved in their original condition, except that goods have quality problems when received;

(2) the return of goods should be kept brand new, the relevant accessories are complete;

(3) warranty cards and other written materials accompanying the goods are not filled out and any defacement, folding;

(4) the outer package, labels, accessories, etc. are intact; 

 

2. Circumstances not eligible for return or exchange of goods.

(1) there are quality problems with the goods;

(2) the serial number of the goods that the dealer itself carries does not match the agreed when the dealer sold them (the serial number of the goods sold by the dealer should match the agreed);

(3) the warranty label, body, packaging, warranty card bar code (S/N code) of the goods has been altered, torn, moved or is unreadable.

(4) The merchandise purchase certificate, warranty card has been altered, torn or lost;

(5) The machine has been damaged by disassembly, repair or upgrade without consent;

(6) The machine has been damaged because it has not been used, maintained or stored in accordance with the merchandise instructions.

(7) Traces of man-made damage caused by the failure or breakage of the machine structure due to movement, dropping, collision, extrusion, etc.;

(8) Traces caused by missing accessories or packaging with stains and serious residues of goods; (9) Damage caused by improper packaging or transportation operations when returning goods to the dealer.

(10) goods factory packaging with seals (subject to the contents of the store and the description of goods), the removal of the seal.

 

Beauty & Skincare

1. Basic conditions for requesting the return and exchange of goods.

(1) goods should be kept in the original appearance as it is received; for example, gifts or freebies shall be returned together;  except that goods have quality problems when received.

(2) the outer package and user manual should be intact with no no stains or no damage;

(3) goods must not have obvious fingerprints, or sweat stains, etc.

(4) special labels for goods should remain intact.

(5) for goods with less than 6 months before expiry dateand merchant does not particularly notify ahead its eligibility of return.

2. Circumstances not eligible for return or exchange of goods.

(1) there are obvious fingerprints, sweat stains or signs of use, etc., whichever affects the second sale of goods;

(2) the outer package of goods, instructions, etc., are stained, damaged or missing;

(3) goods less than 6 months before the expiration date, and merchant has notified or stated ineligibility of return or exchange;

(4) special labels of goods are torn, broken or missing;

 

Home/Bed

1.Basic conditions for requesting the return and exchange of goods.

(1)goods should be preserved in their original condition, except that goods have quality problems when received;

(2) the outer package, labels, accessories, etc. are intact; 

(3) the appearance of the goods and accessories should be without wear and tear;

(4) the original packaging of the goods is intact without damage;

(5) Personal care products and pet foods with a shelf life less than half the original shelf life of the merchandise may be returned or exchanged and the merchant does not clearly indicate this.

2. Circumstances not eligible for return or exchange of goods.

(1) the merchandise has been washed, artificially damaged, and shows signs of use that affect the second sale;

(2) the warranty card, sales receipt, and accessories accompanying the merchandise are stained, broken, or missing;

(3) the merchandise and accessories are worn and damaged;

(4) No refunds or exchanges is for the merchandise with unauthorized repairs, improper use, neglect, misuse, accidents, alterations and improper installation .

(5) the shelf life of the goods is within half of the original shelf life of personal care products, pet food, dealers having clear instructions to inform;

(6) special customized goods.

 

Books & Audio

1. Basic conditions for requesting the return and exchange of goods.

(1) the returned goods should be kept in the original appearance as it is when received, except that goods have quality problems when received; 

(2) books have problems with binding, including missing pages, folds, blurred, folded, open glue, etc.;

(3) proof of purchase of these goods should be intact, and the plastic package of goods related to music, film, television and software are not open;

2. Circumstances not eligible for return or exchange of goods.

Books and audiovisual products are not eligible for return or exchange once they are sold, except for quality problems.

 

Food/Healthcare Products

1. Basic conditions for requesting the return and exchange of goods.

(1) the returned goods should be kept in the original appearance as it is when received, except that goods have quality problems when arrived;

(2) goods package is intact and not being open;

(3) shelf life or expiry date of the goods is more than half a year;

2. Circumstances not eligible for return or exchange of goods.

(1) goods with less than 3 months expiration date, and merchant specifically notified ahead or has stipulated ineligibility of return or exchange;

(2) invoice, user manual, package, etc. Is stained, damaged, or is missing;

(3) goods have traces of being used;

(4) goods once unpacked, it can not be returned;

(5) liquid products are not in the scope of this return policy;

 

Mother and baby category

1. Basic conditions for requesting the return and exchange of goods.

(1) goods should be preserved in their original condition, except that goods have quality problems when received

(2) the package of goods shall be intact;

(3) food products are less than 3 months from the expiration date, and merchant does not particularly notify ahead its eligibility of return.

(4) goods expiration date are less than half of its shelf life, and and merchant does not particularly notify ahead its eligibility of return.

2. Circumstances not eligible for return or exchange of goods.

(1) sales receipt, user manual, package and attachment of the goods are stained, damaged, or missing;

(2) the goods or accessories are worn, damaged, or being used;

(3) the food is less than 3 months before the expiration date and, and merchant particularly notify ahead its eligibility of return.  

(4) goods other than food are of less than half of the original expiration date or have expired already, and merchant specifically notified or has stated the ineligibility of return or exchange;

(5) For special circumstances not stipulated in this policy, Khomall the platform will involve and make final judgment.

 

Jewelry category

1. Basic conditions for requesting the return and exchange of goods.

(1) goods should be preserved in their original condition, except that goods have quality problems when received;

(2) goods should remain brand new and complete with all attached accessories;

(3) warranty card, invoice and other written materials accompanying the goods are not filled out;  or have no defacement or folds;  

(4) the original packaging, external package, original goods and attachments of the returned goods is kept intact;

2. Circumstances not eligible for return or exchange of goods.

(1) goods warranty labels, packaging, certificates, etc., are altered, torn, or displaced;

(2) Purchase receipt, warranty card is altered, torn or lost; goods are disassembled or repaired without authorization;

(3) traces of human damage, malfunction or breakage due to moving, dropping, bumping, crushing of goods;

(4) The packages of the goods is stained or at serious debris;

(5) Damage is caused by improper packing or transportation when goods is returned to merchant;

 

Category of Virtual/Service

Once such goods are confirmed of receipt, they are not eligible for return; as not eligible for 7-Day Return without Cause Policy; except there is provided proof that the service, or the card number, or password etc. cannot be used. If two parties cannot reach agreement, buyer shall request Refund and then request the Platform Intervention, which Khomall the platform will have the right to give final judgement over the return or refund of products.

 

Note: If product categories or situation are included in the scope of this c, respective national law and regulations will apply. Customized products and virtual cards are not in the scope of in the Khomall 7-Day Return without Cause Policy.

 

 

Content of Khomalls Seven Days Return without Cause Policy

 

1. Buyers should provide details when applying Khomall’s 7-Day Return without Cause Policy. If return reason is subjective factors as dissatisfaction or dislike of the product; product must not be used, the original packaging must remain intact, and the re-sale of the product must not be affected. if the product has quality and other related problems, indicate the return reason whilie request.

Buyer, please follow below to request return or exchange,

(1) Choose the reason for return or exchange and provide picture evidences.

(2) If refund type is incorrectly applied, contact Platform in a timely manner for modification. The Platform will review and process the application within 2 business days from initiation.

 

2. Once buyer requests refund, both buyer and merchant shall abide by the Khomall’s 7-Day Return without Cause Policy and actively negotiate with each other in a cooperation-to-solve- issue manner. Merchants explanations with evidence will be the basis for judging the case.

Merchant, please follow below to handle the case,

(1) Respond to buyer's request timely;  

(2) If merchant is to reject request, upload proof and explain reason for rejection following Reject” button.

(3) If merchant is to accept return or exchange, respond and inform buyer timely and arrange for next step;  

(4) If buyer request wrong refund type, contact Platform in time to involve in the situation.  Platform will review and process the application within 2 working days.

 

3. Processing principles.

(1) If buyer and merchant reach agreement to cancel refund after negotiation, buyer can cancel refund with "Cancel" button in order page within 1 day after refund initiation.

(2) If merchant agrees the return of goods for refund or exchange, two parties will follow given procedures to finish the return or exchange.

(3) If two parties are unable to reach an agreement, the procedures stipulated by Khomall's 7-Day Return without Cause Policy will be followed. Buyer has a 7-day window to click “Refund” when order is in Transaction Successful status. When Platform Intervene is requested, Khomall will review the request within 1 day after refund is applied, and will process it within 20 business days. If the request is confirmed accepted, Khomall shall have the right, at its sole discretion, to directly deduct the deposit from merchant's account in accordance with the Khomall Merchant Agreement, compelling the merchant to fulfill their commitment to Khomall's7-Day Return without Cause Policy. Within 20 business days after the merchant receives the returned goods (subject to record of logistics company), Khomall has the right to make the above refunds and deductions in accordance with these rules.
